Islamic law is distinguished from other legal systems by being a universal law for all humanity, applicable to all times and places. It employs a timeless approach that keeps pace with science and progress, providing appropriate solutions to all issues facing human society in various fields. This is because Islam came to reform human society and establish a balanced and moderate system aimed at achieving justice and equilibrium among all segments of society, preserving their rights without excess or negligence. Among these issues is the matter of personal status.
The subject of personal status is of paramount importance, both in human society in general and in Iraqi Islamic society in particular, due to its role in regulating individual affairs and related family and social relationships, as well as addressing contemporary challenges.
To keep pace with the developments of the times, address thousands of societal problems, guarantee rights, and uphold international covenants and agreements, a unified Iraqi Personal Status Law No. 188 of 1959 was drafted. However, this law contained many shortcomings and flaws. Therefore, the religious authority, represented by Sayyid Muhsin al-Hakim (may God sanctify his soul) (d. 1970), called for its repeal due to its contradiction of Islamic law and its negative impact on society. Nevertheless, the Personal Status Law remains in effect to this day, with some amendments to its articles.
